A fair, readable agreement between you and CoolCove.
By using the CoolCove website, buying a CoolCove product, or creating an account in the CoolCove companion app, you agree to the terms below. We have written them as plainly as we can, and we mean exactly what they say. If anything is unclear, please write to us and we will fix it.
CoolCove Climate Studio, LLC, a Delaware limited liability company. Our full mailing address and contact email are published on the homepage of this site.
The individual or business entity using the CoolCove website, app, or products. If you accept these terms on behalf of a company, you represent that you have authority to bind that company.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a CoolCove account or place an order. When you create an account, you agree to:
We reserve the right to suspend or terminate accounts that contain false information, are involved in fraudulent activity, or have been inactive for more than five years. We will give reasonable notice before any such suspension when practicable.
All product listings on the CoolCove website are an invitation to treat, not a contractual offer. A binding contract of sale is formed only when we (a) charge your payment method in full, and (b) send you an order-confirmation email. We may decline any order prior to that point, including for reasons of suspected fraud, pricing errors, or insufficient inventory, in which case any pre-authorization on your card will be released.
Prices are listed in U.S. dollars and exclude applicable sales tax, VAT, GST, customs duties, and shipping, all of which are calculated and disclosed at checkout. We accept the payment methods displayed on the checkout page, processed by our PCI-DSS Level 1 payment processor. Full payment data is never stored on CoolCove systems.
If a product is listed at an incorrect price due to a typographical, system, or human error, we may, at our discretion, contact you for instructions or cancel the order and refund any amounts charged.
CoolCove ships to the address you provide at checkout. Title and risk of loss pass to you when the carrier delivers the package to the address you specified (or, in the case of carrier-signed deliveries, when an adult at that address signs for the package). Estimated delivery windows are provided for convenience only and are not guaranteed.
You are responsible for providing a complete and accurate shipping address, including apartment numbers and gate codes. We are not liable for delays or failed deliveries caused by incorrect addresses, recipient absence, building access restrictions, or force-majeure events. If a package is returned to us as undeliverable, we will contact you to arrange redelivery; redelivery shipping charges may apply.
CoolCove hardware is backed by a limited manufacturer warranty, the full terms of which are published on our warranty page and printed in the box with every unit. The warranty covers defects in materials and workmanship under normal residential use for the period stated on your order confirmation.
CoolCove also honors a 30-day satisfaction return window for units purchased directly from coolcove.example. To initiate a return, contact our support team at the address on the homepage. Returned units must include all original packaging, accessories, and documentation, and must be shipped in a manner that prevents damage in transit. A restocking fee of up to 10% may apply to returns showing signs of use beyond what is necessary to inspect the unit.
This Chapter 05 does not affect any statutory rights you may have under the consumer-protection laws of your jurisdiction.

All content on this website and in the CoolCove app — including text, graphics, logos, icons, images, audio clips, video, software, and the compilation of all such content — is the property of CoolCove Climate Studio, LLC, or its licensors, and is protected by U.S. and international copyright, trademark, and design-patent laws.
You may view, download, and print a single copy of website materials for personal, non-commercial reference, provided you keep all copyright and proprietary notices intact. Any other use — including reproduction, modification, distribution, republication, or transmission — requires our prior written consent.
The CoolCove app integrates with third-party services such as Amazon Alexa, Google Assistant, and Apple Shortcuts. Your use of those services is governed by their own terms, not by these Terms of Service. CoolCove is not responsible for the availability, accuracy, or content of any third-party service.
CoolCove firmware includes open-source components, each of which is licensed under its own applicable open-source license. A complete list of open-source components and their licenses is published in the "Open-Source" section of the in-app settings menu and updated with every firmware release.
To the maximum extent permitted by applicable law, the CoolCove website, app, and documentation are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the operation of any product or service will be uninterrupted or error-free.
To the maximum extent permitted by applicable law, in no event shall CoolCove, its affiliates, officers, directors, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or goodwill — arising out of or in connection with your use of, or inability to use, the products, app, or website, even if CoolCove has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion of certain damages, our total liability shall not exceed the amount you paid CoolCove for the product or service at issue during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms of Service is intended to exclude or limit liability that cannot be excluded or limited under the consumer-protection laws applicable in your jurisdiction.
You agree to indemnify, defend, and hold harmless CoolCove and its officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to (a) your breach of these Terms of Service; (b) your misuse of any CoolCove product, app, or service; or (c) your violation of any applicable law or the rights of a third party.
These Terms of Service remain in effect for as long as you use the CoolCove website, app, or products. You may terminate them at any time by closing your account, stopping use of the products, and (if applicable) requesting deletion of your data in accordance with our Privacy Policy. CoolCove may terminate or suspend your access if (a) you materially breach these terms and fail to cure within 14 days of notice, (b) your use of the services creates a security or legal risk for CoolCove or other users, or (c) we are required to do so by law.
Sections that by their nature should survive termination — including those governing intellectual property, disclaimers, indemnification, and dispute resolution — will survive.
These Terms of Service are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing any formal legal action, you and CoolCove agree to attempt to resolve the dispute informally by contacting our support team at the address listed on the homepage. We will attempt to resolve the dispute by contacting you via email. If a dispute is not resolved within 30 days of submission, either party may pursue formal remedies in the state or federal courts located in New York County, New York, except where applicable consumer law provides for the courts of your home jurisdiction.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual-property or other proprietary rights.
We may revise these Terms of Service from time to time. The "Effective Date" at the top of this page reflects the most recent update. Material changes will be announced with a banner on the homepage for at least 30 days and, where required by law, by email. Continuing to use the CoolCove website, app, or products after a change becomes effective means you accept the updated terms. If you do not accept the updated terms, your sole remedy is to stop using the services and contact us to close your account.
All notices to CoolCove under these Terms of Service should be sent to the email or postal address listed on the homepage of this site. We will send notices to you at the email address associated with your account or, for important matters, by physical mail to your last-known billing address.
